Who is responsible for processing your personal data?

RSPA BELLA S.L. and MADESS BELLEZA S.L. are the DATA CONTROLLERS responsible for processing the USER’S personal data and inform you that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

Why do we process your personal data?

To maintain a commercial relationship with the user. The processing activities include:

• Sending commercial and advertising communications via email, fax, SMS, MMS, social media or any other present or future electronic or physical means that enables commercial communications. These communications will be carried out by the CONTROLLER and will relate to its products and services, or those of its collaborators or suppliers with whom promotional agreements have been established. In such cases, third parties will never have access to personal data.
• Conducting market research and statistical analysis.
• Processing orders, requests, responding to enquiries or any type of request made by the USER through any of the contact methods available on the CONTROLLER’S website.
• Sending online newsletters regarding news, offers and promotions related to our activities.

 

What is the legal basis for processing your personal data?

The processing is based on Article 6 of the GDPR as follows:

• User consent: for sending commercial communications and newsletters.
• Legitimate interest of the CONTROLLER: for conducting market research, statistical analysis and processing enquiries, requests and orders made by the USER.

 

How long will we keep your personal data?

Data will be retained only for as long as necessary to fulfil the purpose of processing or to comply with legal obligations requiring its retention. Once no longer required, the data will be securely deleted or anonymised.

Who do we share your personal data with?

No personal data will be disclosed to third parties unless necessary for the development and execution of the processing purposes, in which case data may be shared with service providers related to communications. The CONTROLLER has signed the corresponding confidentiality and data processing agreements required under current privacy legislation.

What are your rights?

You have the right to:

• Withdraw your consent at any time.
• Access, rectify, transfer or erase your personal data.
• Restrict or object to the processing of your data.
• Lodge a complaint with the supervisory authority (www.aepd.es) if you believe that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By checking the corresponding boxes and entering data into the fields marked with an asterisk (*) on contact forms or download forms, USERS expressly, freely and unequivocally accept that their data is necessary to process their request. The inclusion of data in the remaining fields is voluntary.

The USER guarantees that the personal data provided to the CONTROLLER is accurate and undertakes to communicate any changes thereto.

The CONTROLLER informs users that all data requested through the website is mandatory, as it is necessary to provide an optimal service. If all requested data is not provided, it cannot be guaranteed that the information and services offered will fully meet the user’s needs.

In accordance with current personal data protection regulations, the CONTROLLER complies with all provisions of the GDPR and LOPDGDD regarding the processing of personal data under its responsibility, and specifically with the principles set out in Article 5 of the GDPR, ensuring that data is processed lawfully, fairly and transparently, and is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.

The CONTROLLER guarantees that it has implemented appropriate technical and organisational policies and measures to ensure compliance with the GDPR and LOPDGDD and to safeguard the rights and freedoms of USERS. Appropriate information has also been provided so that users may exercise their rights.
